Our Contract
WORK FOR HIRE FLAT FEE AGREEMENT
On this date ____/____/____ PecksPublishing.com hereafter known as the Pecks of 7900 North Virginia Street, Suite 106 Jade, Reno, Nevada, 895066,
and the writer, hereafter known as Author, AKA named: __________________________, Address: __________________________________________________________, hereby confirm the understanding between the Pecks and the Author regarding work to be done by the Pecks as more fully described below.
1.a The Pecks, a Christian family business, will print the following number of books, __________________, (plus 2 additional to be signed by the Author for the Pecks), that contain the following number of pages, _____________________________________. The Works are to be printed in black ink with full color front and back covers, (highlight correct size book) 8.5" x 11", with plastic comb binding or saddle stitched in 5.5" x 8.5". The Author may include up to 8, full color, quarter pages of photos, clip art, graphics or tables, submitted to the Pecks by the Author as stated on our Step 2 Submission Instructions web page, fully edited and ready for printing no later than seven days from the date this contract is digitally signed and submitted, hereafter known as the "Work". If any editing or grammatical errors are found in the submitted works, the Pecks will not correct the Works.
1.b The Pecks agree to print, bind, package for shipping and have ready for the Author to pay for, order pick up and shipping of the Work no later than 30 business days from the date that both manuscripts are received by the Pecks.
2. Within 72 hours of sending the Works to the Pecks, the Author agrees to pay the Pecks $_________________, (and two signed books which the Author will pay to send to the Pecks within 72 hours of receiving the shipment of the printed Works), for the above listed services in item 1.a. The Author will not make any further payment to the Pecks.
3. The Pecks expressly acknowledge that the material contributed by them hereunder, and their services hereunder, are being specially ordered and commissioned by the Author for use in printing the following titled Works: _________________________________. The Work contributed by the Pecks hereafter considered a "work made for hire" as defined by the copyright laws of the United States. The Author shall be the sole and exclusive owner and copyright proprietor of all rights and title in and to the results and proceeds of the Pecks services hereunder in whatever stage of completion. If for any reason the results and proceeds of the Pecks services hereunder are determined at any time not to be a "work made for hire", the Pecks hereby irrevocably transfer and assign to the Author all right, title and interest therein, including all copyrights, as well as all renewals and extensions.
4. The Pecks agree that the Author may make any changes or additions to the Work after printed by the Pecks, in another edition with the pecks or a different printing/publishing company, which the Author has sole discretion and may consider necessary, and may engage others to do any or all of the foregoing, with or without attribution to the Pecks. The Pecks further agree to waive any so-called moral rights in the Work.
5. The Pecks represent that, except with respect to material furnished to the Pecks by the Author, the Author is the sole author of the Work. All of the Pecks services are original with the Author and not copied in whole or in part from any other work; that the Authors' Work is not libelous or obscene, or knowingly violates the right of privacy or publicity, or any other rights of any person, firm or entity. If the Works are found to be such, the Author will pay for the entire legal defense of Pecks if a lawsuit ensues.
The Pecks will advise the Author when the Works are complete, packaged and ready to ship so the Author may order and pay for pickup and shipping of the works. After receiving the Works the Author garees to sign two copies of the finnished works, pay for shipping to return these two books to the printer. This action closes and finalizes the contract between the Author and the Pecks.
If the above reflects the Authors understanding, please sign below to reflect the Authors agreement to the above terms and the Authors intention to be bound hereby.
